Loan deal, future fee and contract expiry date

As everyone knows, Eric Garcia is down to leave Manchester City on a free at the end of the first season. 

But.... 

If you took him on loan (as an English club) and there was a mandatory/optional future fee to purchase included in the loan deal, could other non-English clubs still offer him a contract in January? 

I would assume that they wouldn't of it was a mandatory fee as it is, pretty much, a guaranteed transfer. But I'm still not sure.

I was under the impression you can't add a mandatory fee into a loan when the player is in the last year of his contract to prevent this, Not got the game open to check though
